Terms of Service
Version 1.2 — effective June 12, 2026 (added: web card payment, clubs and membership fees, guest-shared content)
Welcome to Torool. These Terms of Service (the "Terms") govern the use of the Torool mobile app and the guest webapp accessible from a link shared by an organizer. By creating an account or using the service, you acknowledge that you have read, understood, and accepted these Terms without reservation.
1. The service
Torool is an application that lets you, as an organizer, invite people to an event (dinner, trip, work offsite, wedding, etc.), manage their RSVP through a customizable funnel, and optionally configure a seating plan.
Your guests access their invitation via a web link without creating an account. The service is provided as a native iOS/Android app and a guest webapp.
Depending on the event configuration, optional add-ons are available: carpooling, accommodation, potluck, photo album, guestbook, cost sharing. Torool also offers clubs: spaces allowing an association or community to gather its members and events and, where applicable, collect a membership fee (see article 4).
The cost sharing add-on is purely declarative: Torool is not a payment service provider and does not move any funds between participants. Reimbursements between participants happen directly between them, through the means of their choice (any Lydia / Revolut / PayPal handles displayed are mere information entered by the parties concerned).

3. Account creation
- You must be at least 15 years old to create an account. If you are a minor, you declare having obtained authorization from your parents or legal guardians.
- You provide either an email address + password, or sign in via Apple or Google.
- You are responsible for keeping your credentials confidential. Any action taken from your account is deemed to come from you.
- One natural person per account. Shared accounts are forbidden.
- You agree that service-related communication will be primarily by email.
4. Free plan, Premium, and payments
- Free plan:
- You can create up to 3 events with full features (unlimited guests).
- Beyond the 3rd event, you can still create additional events without limit, but each new event is capped at 5 guests maximum.
- The seating chart feature is never available on the free plan, regardless of the number of events created.
- Premium plan: auto-renewing monthly subscription of €4.90 (incl. VAT) / month ("torool_premium_monthly_499"), unlocking:
- Unlimited events and unlimited guests per event,
- Seating chart feature (drag-and-drop canvas, host-assign / guest-pick modes, lock and activity feed).
- The subscription can be purchased in-app (Apple In-App Purchase on iOS, Google Play Billing on Android) or on the web by card via our provider Stripe.
- The subscription is automatically renewed each month unless cancelled at least 24 hours before the end of the current period. Renewals are billed via your Apple ID, Google Play account, or your card on file with Stripe, depending on the purchase channel.
- Cancellation is performed from your Apple account settings (Settings → Apple ID → Subscriptions), Google Play (Payments & subscriptions → Subscriptions), or — for web subscriptions — from the subscription management portal accessible in the app settings. After cancellation, you retain Premium access until the end of the paid period.
- In-app purchases are validated by our partner RevenueCat; web payments are processed by Stripe. No banking data is processed or stored directly by DBEK.
- Premium status is tied to your Torool account. It can be restored via "Restore Purchases" upon reinstallation, provided you use the same Apple ID or Google ID as the initial subscription.
- For in-app subscriptions, refunds are handled directly by Apple or Google under their respective policies. For web subscriptions (Stripe), any refund request should be sent to contact@dbek.fr.
- DBEK reserves the right to change the subscription price. You will be notified at least 30 days before the new pricing takes effect, and may cancel free of charge if you do not accept the change.
Club membership fees
- A club may offer a paid membership. In that case, the payment is a one-time payment (not an auto-renewing subscription) opening a fixed-term membership, whose expiry date is displayed before payment.
- The membership is sold by the club, not by DBEK. Torool acts as a technical platform: the payment is processed by Stripe and paid out to the club via Stripe Connect. The club organizer is solely responsible for the content of the membership offer, its tax and reporting obligations, and the delivery of the benefits promised to its members.
- Service fees may be added to the membership amount and/or deducted from the amount paid out to the club; they are displayed before payment confirmation.
- A receipt is sent by email after each membership payment.
- Membership fees are not refundable by DBEK. Any refund request should be addressed to the club concerned, which decides under its own rules and applicable law.
- Membership expiry triggers no automatic charge: renewal requires a new voluntary payment.
5. Right of withdrawal
Pursuant to Article L. 221-28 1° of the French Consumer Code, the 14-day right of withdrawal does not apply to the Premium subscription, given that service performance begins immediately after sign-up with your express consent and that you explicitly waive your right of withdrawal.
By finalizing the Premium subscription, you expressly request immediate performance of the service and unambiguously waive your right of withdrawal, as the service is provided as soon as payment is validated (instant unlock of the "unlimited events" feature).
6. Organizer responsibilities
- You warrant that you have the right to invite the people you add to your event and that the collection of their name, email, and phone complies with GDPR.
- You inform your guests, when relevant, that they are added to an event managed via Torool.
- Your guests may ask you to remove or modify their information — you must comply within a reasonable timeframe.
- You will not use Torool for spam, harassment, illegal content, defamation, or any content infringing a third party's rights.
- You are solely responsible for the content you create (event titles, descriptions, notes, messages to guests).
- Guests who publish content on an event (album photos, guestbook messages, carpool listings) are responsible for that content under the same conditions. As the organizer, you can remove any content published on your event.
- If you administer a club with paid membership, you warrant that you are authorized to collect those amounts on behalf of the club and you comply with Stripe's identity verification (KYC) process.
- You agree that manifestly illegal content may be removed without prior notice.
7. Prohibited conduct
The following are notably forbidden:
- Reverse-engineering, mass scraping, or unauthorized automated API use.
- Bypassing the 3-free-events limit (creating multiple accounts, exploiting flaws).
- Using Torool to collect personal data for commercial purposes without explicit guest consent.
- Any illegal activity or activity infringing on others' rights (harassment, defamation, CSAM, incitement to hatred, etc.).
- Using the app to organize illegal events.
8. Intellectual property
- The service, its source code, design, brand name and all components are the exclusive property of DBEK or its licensors.
- The content you create (events, guest lists, seating plans, descriptions) remains yours. Likewise, content published by guests (photos, guestbook messages) remains the property of its authors.
- You and your guests grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, and display this content, strictly limited to providing the service.
9. Service availability
We use reasonable efforts to ensure service continuity but cannot guarantee 100% uptime nor total absence of bugs or errors.
DBEK cannot be held liable for unavailability resulting from force majeure within the meaning of Article 1218 of the French Civil Code (subprocessor incident, major network outage, administrative decision, labor dispute, exceptional climate event, etc.).
10. Suspension or termination by the publisher
DBEK reserves the right to temporarily suspend or permanently terminate an account in case of:
- Breach of these Terms (notably articles 6 and 7);
- Established fraudulent activity (payment fraud, abusive chargeback, limit circumvention);
- Reasoned request from an administrative or judicial authority;
- Security risk (compromised account, suspicious automated behavior).
Except in case of manifest fraud or security emergency, termination is preceded by a warning and a reasonable timeframe to remedy. No refund is due in case of termination for breach of Terms.
11. Deleting your account
You can delete your account at any time from the app: Settings › Account › Delete my account. You may also request deletion by email at contact@dbek.fr.
Deletion triggers erasure of all your data and your guests' data within 30 days (backups included), with the exception of accounting records that must be retained for 10 years by legal obligation.
Premium purchase does not give right to a refund in case of voluntary account deletion.
12. Personal data
Personal data processing is detailed in our Privacy Policy, which is an integral part of these Terms.
13. Apple App Store and Google Play specific provisions
If you downloaded the app from Apple's App Store, you acknowledge that:
- These Terms are concluded between you and DBEK, not with Apple.
- Apple has no obligation to provide any maintenance or support service for the app.
- Apple is not responsible for any claim related to the app (quality, performance, legal compliance).
- Apple is a third-party beneficiary of these Terms for the purposes of their enforcement.
- You represent that you are not located on a US sanctions list (OFAC) and do not reside in a country under US embargo.
If you downloaded the app from Google Play, Google Play's additional terms apply in addition to these Terms (play.google.com/about/play-terms).
14. Warranties and limitation of liability
The service is provided "as is", without warranty of being bug-free or fit for a particular purpose.
To the fullest extent permitted by law, DBEK's total liability towards you, all damages combined, is capped at the amount you paid to DBEK for the service over the last 12 months (for example, €58.80 for 12 months of Premium at €4.90). Membership fees paid to a club via Stripe Connect are received by the club, not by DBEK, and are not included in this calculation.
This limit does not apply in case of damage resulting from intentional or gross fault by DBEK, nor in other cases where applicable law prohibits it (notably towards consumers).
DBEK is in no event liable for indirect damages, loss of opportunity, data loss caused by a third party, or content published by you or your guests.
15. Mediation and amicable settlement
Pursuant to Article L. 612-1 of the French Consumer Code, in case of a dispute unresolved with customer service after a prior written complaint, you may free of charge resort to a consumer mediator.

16. Governing law and jurisdiction
These Terms are governed by French law.
Any dispute relating to their interpretation or execution shall fall under the exclusive jurisdiction of the courts within the Paris Court of Appeal area, subject to mandatory legal provisions in favor of the consumer (including the consumer's right to bring proceedings before the court of their domicile).
17. Changes to the Terms
DBEK may update these Terms. Any substantial change will be notified to you in the app at least 30 days before it takes effect. If you do not agree with the new Terms, you may delete your account before they apply; otherwise, you will be deemed to have accepted them.
